********** Unitek - NetApp Training Terms & Conditions ********** *** Enrollment Policy *** Class enrollment is accepted on a first pay first served basis. A seat may be temporarily reserved using a signed and faxed copy of this enrollment agreement; however Unitek cannot guarantee a seat until full payment has been received. Students who have not paid in full will not be admitted to the class. For NetApp Training Units, payment is considered to be received only after the Training Units have been validated and decremented by NetApp University. Please do not make any travel arrangements until you receive an enrollment confirmation from a Unitek team member. The registration fee covers course tuition and all course materials. All other fees including parking, travel, lodging, food, if any, are not included. *** Cancellation & Rescheduling Policy *** A student may cancel from or reschedule a class that he/she enrolled for. All requests to change a registration must be in writing via e-mail to "netappsupport@ unitek.com" or faxed to us at 510-225-0367. Cancellations made 11 or more business days prior to the class start date will incur 0 registration fee plus a processing fee. Cancellations made between 6 - 10 business days prior to the class start date will result in forfeiture of 50% of the class tuition fees. No refunds will be issued on cancellations made less than 6 business days from the class start date. Any class credit that student may have on Unitek's books will lapse 12 months from the originally scheduled class date. No refunds are issued on reschedules. Reschedules made between 6 - 10 business days prior to the class start date will incur a 0 Rescheduling Fee. Reschedules made less than 6 business days before the class start date will result in forfeiture of 25% of the class tuition fees. Reschedules made less than 3 business days before the class start date will result in forfeiture of 50% of the class tuition fees. If student cancels after rescheduling, no refunds will be issued. Only one reschedule is allowed, and the rescheduled class must be taken within six months of the originally scheduled class date. If the same class is not offered in the future, no refund will be issued. For all cancellation or reschedules, Unitek assumes no liability for any non-refundable costs that Unitek or the student may incur for student or on student's behalf (example airfare or hotel). If Unitek cancels a course for any reason, liability is limited to the registration fee only. Any amount due to student will be refunded within 30 business days. *** No Shows *** Failure to attend a scheduled class without a written notice prior to the start date of the course will be considered a "no show" and will result in forfeiture of the full course price, including any incurred travel and/or lodging expenses. Failure to cancel a hotel reservation, made through Unitek, without written notice prior to the class start date will result in forfeiture of 2 nights of the hotel charge. Unitek, at its own discretion, may allow a no show student to attend another session of the same or lower priced course. *** General Terms *** 1. This agreement constitutes the complete and fully integrated contract between Unitek and Student, and supersedes all previous oral and written agreements and discussions. This agreement may be changed only by an agreement in writing between Unitek and Student. Student has read and understood this agreement and has not entered into this agreement in reliance on any promises made by Unitek or any of its counselors or agents. 2. Student agrees to comply with Unitek's rules and procedures, including, but not limited to absences, tardiness, honesty & proper conduct. 3. Although Unitek will make its best efforts to notify students in the event that any class has been canceled or postponed, it is the student's responsibility to contact Unitek to confirm his or her attendance in the class at least two business days before the scheduled class. Unitek is not responsible for student's / student's travel, lodging, incidental expenses or other losses or damages incurred if the student does not confirm his or her attendance in the class, and the class has been cancelled or postponed. 4. Day classes are generally held from 9 AM to 5 PM. Class times for bootcamps and combos follow Unitek's announced schedule. All course schedules are subject to change in start and completion dates. Students will be duly notified. 5. In the event of natural disasters, Acts of God, labor disputes, or equipment failure, Unitek reserves the right to postpone training upto a maximum of 30 days. Students will be duly notified. 6. Unitek reserves the right to withdraw a scheduled program if the registration is insufficient to host a class. 7. If meals are provided to student, Unitek does not guarantee that the meals will meet student's special dietary requirements. Students with special dietary requirements are responsible for providing their own food during the duration of any course attended at Unitek. 8. Student agrees that any legal action brought to enforce or interpret any term of this agreement, or involving student's relationship with Unitek, shall be brought exclusively in the Superior Court of California for the County of Alameda, and student submits to the personal jurisdiction of that Court. The prevailing party in such suit shall be entitled to recover its reasonable attorney's fees and costs of suit from the losing party. 9. If any section of this agreement shall be deemed invalid or unenforceable, it shall not affect the other sections hereof, and this agreement shall be construed in all respects as if such invalid or unenforceable section was omitted. 10. If this Agreement is assigned to a third party, Student and co-signer, if applicable, will continue to be bound by all the terms and conditions of this Program Enrollment Agreement. Should this agreement be assigned, such a third party is independent of Unitek. Any Unitek related questions or problems that arise must be settled between Student and Unitek. 11.While attending training classes with Unitek, student may come in contact with other Unitek students, as well as Unitek's own employees and contractors. Student covenants and agrees that he/she shall not directly or indirectly solicit or facilitate (by communication of any nature) the hiring of any of Unitek's clients, employees or contractors for a period of 2 years after student's last day of attending training with Unitek. Student may engage in, and Unitek encourages, the solicitation of work from Unitek by communicating such requests directly to Unitek's Management, Sales, or Account Management staff. The parties agree that if student/student's employer hires or utilizes Unitek's personnel in violation of this paragraph, Unitek will have been damaged, but that the amount of damages are difficult to ascertain. Accordingly, the parties agree that if student/student's employer violates this paragraph, student/student's employer will pay Unitek ,000.00 as liquidated damages.
